Welcome to Campus Swap. These Terms and Conditions ("Terms") constitute a legally binding agreement between you and Campus Swap ("Campus Swap," "we," "us," or "our") governing your access to and use of the website usecampusswap.com and related services (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. Acceptance of Terms
By creating an account, browsing listings, listing items, making purchases, or otherwise using the Service, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Description of Service
Campus Swap operates an online marketplace for used furniture and items on college campuses. Sellers can list items for pickup, storage, and resale. Buyers can purchase items from our inventory. We handle pickup, storage, photography, pricing, and in-person sale. Our Service is currently available at UNC Chapel Hill and may expand to other campuses.
3. Eligibility
You must be at least 13 years of age to use the Service. If you are under 18, you should have a parent or guardian review these Terms. By using the Service, you represent that you meet these requirements and that all information you provide is accurate and complete.
4. Account Registration and Security
To use certain features, you must create an account by providing your email address and, optionally, signing in with Google. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.
5. Use of Service — General Rules
You agree to use the Service only for lawful purposes and in compliance with these Terms and all applicable laws. You agree not to:
- List prohibited items (e.g., hazardous materials, stolen goods, items that violate third-party rights)
- Misrepresent items, their condition, or ownership
- Engage in fraudulent or deceptive conduct
- Interfere with or disrupt the Service or our systems
- Scrape, copy, or harvest data from the Service without permission
- Use the Service to harass, abuse, or harm others
We reserve the right to suspend or terminate accounts that violate these rules or for any other reason we deem appropriate.
6. Seller Terms
If you list items as a seller:
- You grant Campus Swap the right to pick up, store, photograph, display, and sell your items through our platform.
- You must pay the applicable service fee (e.g., one-time $15 pickup fee) as displayed at signup. Additional items are not charged beyond the pickup fee.
- You represent that you own the items or have the right to sell them, and that they are accurately described.
- When your item sells, you will receive 50% of the sale price (for online submissions) or 33% (for in-person drop-offs), minus any fees, as specified at the time of listing.
- Payouts are processed via the method you select (e.g., Venmo, Zelle).
- Items that remain unsold after our specified period may be donated or disposed of at our discretion.
By listing items, you agree to our pickup scheduling, storage, and payout terms as communicated during the signup and listing process.
7. Buyer Terms
If you purchase items through Campus Swap:
- All purchases are generally final, subject to our Refund Policy.
- Items must be picked up in person at our designated store location within the timeframe specified at purchase.
- You are responsible for inspecting items at pickup. We encourage buyers to verify condition before leaving.
- Payment is processed at the time of purchase via Stripe. You must provide valid payment information.
8. Fees and Payments
Service fees, seller activation fees, and item prices are displayed at the time of transaction. All fees are non-refundable except as stated in our Refund Policy. We use Stripe for payment processing; by paying, you also agree to Stripe's terms. Currency is in U.S. dollars.
9. Intellectual Property
The Service, including the Campus Swap name, logo, branding, content, design, and materials, is owned by Campus Swap and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent. You retain ownership of content you submit (e.g., item photos), but you grant us a non-exclusive, royalty-free license to use, display, and distribute that content in connection with operating the Service.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, CAMPUS SWAP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO CAMPUS SWAP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY; IN SUCH CASES, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
12. Indemnification
You agree to indemnify, defend, and hold harmless Campus Swap and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from (a) your use of the Service, (b) your violation of these Terms or any law, or (c) your violation of any third-party rights, including intellectual property or privacy rights.
13. Dispute Resolution
Any disputes arising from these Terms or the Service shall first be addressed by contacting us at team@usecampusswap.com. We will attempt to resolve the dispute in good faith. If we cannot resolve the dispute within 30 days, either party may pursue any available legal remedy. These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles.
14. Changes to Terms
We may modify these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. Material changes may also be communicated via email or a notice on the Service. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.
15. General
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right or provision does not constitute a waiver. These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and Campus Swap regarding the Service.
